EARTHEN BODY ONLINE SHOP

Earthen Body(ABN 39 895 384 612) may see fit to add or amend any or all of these enclosed terms and conditions without notice.

Before ordering from Earthen Body, please ensure you have read and understood all our terms and conditions that are listed on this page. These Conditions of Sale form an agreement with you, the "buyer", and applies to any purchase made by the buyer from the "seller", Earthen Body, PO Box 4013, Tinana QLD 4650.

The seller may choose to alter some conditions of sale from time to time, at their discretion. These conditions of sale are subject to the laws of Queensland, Australia. Prices are correct at time of publishing. Earthen Body reserves the right to change prices without notice.

Legal Transactions

Only customers over the age of 18 or customers who are under the age of 18 but have the consent of their guardian are legally entitled to place orders with the Earthen Body telephone sales centre and www.shopnatural.earthenbody.com.au online store.

Some of the product range may be available for wholesale purchasing at wholesale prices which are not available to the general public, who may purchase their items directly from the Earthen Body online store. Wholesale products at wholesale prices are only available to qualified beauty salons, clinics, medispas and qualified beauticians, clinicians and dermal therapists, We reserve the right to check ABN numbers and/or trade qualifications prior to processing a wholesale order.

Supply & Delivery Of Your Products

You will be supplied goods as indicated on your order confirmation. This confirmation is emailed to you, the buyer. Where stock is unavailable you will be notified and given options to proceed with or change your order. In the event stock is unavailable and you choose to cancel your order, a refund will be processed within 48 hours where practicably possible.

Australian deliveries will occur within 5 working days from the date we receive your payment. Delivery times are business days (Monday to Friday), excluding public holidays. The seller will deliver the goods to the address indicated on your order. Where possible we will always try to exceed our delivery estimation, however, we do not guarantee we will deliver within this time frame. Delivery is dependent on stock availability and any date quoted is an estimate only. We are not responsible for lost/delayed goods or for the actions of courier/delivery drivers of companies.

On delivery, title of the goods passes to you the buyer provided full payment has been received. Delivery costs will be calculated according to your location and the weight and size of your order once packed. We will always endeavour to get the best delivery price and freight method for each order.

You or your agent must be at the delivery address to take delivery of the goods. We will not be liable for damage to or loss of goods left at your unattended delivery address.

Ordering Goods

You can place an order by shopping online at our website: www.shopnatural.earthenbody.com.au, or through our telephone sales centre (0416 196 167). We will forward an order number by email if your order is placed on the web. You are to use this order number in any correspondence with the seller. Based on all the conditions of sale you make an offer to purchase the goods selected. The seller has the right to cancel the order for any reason it deems. If the seller cannot process your order we will endeavour to contact you by all means available to us.

You will be invoiced for goods at prices current at the date of dispatch. We reserve the right to specify a minimum order value which we shall accept.

Payment Of Goods

Payment is to be made in full to Earthen Body prior to dispatch of any order, using one of the following methods:

PayPal: Payments may also be completed through your PayPal account. Simply select PayPal at the checkout, login when instructed and select the payment method of your account that you wish for payment to occur through (ie. a credit card or directly from a bank account).

Credit Card: We accept MasterCard and Visa credit cards. We also accept Visa Debit and MasterCard Debit cards. For authorisation purposes, you will need to provide the card number, name of cardholder and expiry date. All credit cards are processed through the PayPal merchant facility. You do not need to have a PayPal account to use this service. At the checkout, select the Credit Card option to access the PayPal credit card processing facility.

Direct Deposit: Payments can also be deposited directly into our account. Upon ordering you will be emailed an invoice for the total amount including freight. You will also be supplied with our bank details and reference. If you choose to direct deposit you MUST advise us after doing so to enable us to dispatch your order. At the checkout, select the Direct Deposit option. Please email through confirmation that payment has indeed been made.

Cash: Cash is accepted ONLY for transactions ordered and collected from our office. Do not mail cash to our office. We do not accept responsibility for cash that has been posted. At the checkout, select the Cash option and please contact us immediately to arrange for delivery/collection.

All purchases are in Australian dollars (AUD) and include 10% GST, unless otherwise stated.

In the event that legal action is required to recover goods or monies owed to Earthen Body, the buyer shall be liable for all legal costs incurred in such recovery.

Title of goods shall not pass unless payment is made in full.

Return Of Goods

Please choose carefully as no refund or credits are available if you choose incorrectly or fail to properly check and verify your order. The buyer shall bear the costs of any replacement/exchanged goods incorrectly ordered by the buyer including freight. All goods to be returned, replaced or exchanged must be accompanied with a photocopy of the original invoice.

The seller will only offer a refund when a replacement is not available.

The buyer must advise Earthen Body of any damaged or faulty products within 2 days of the receipt of goods. Where goods are to be returned, they must be returned within 7 days of the initial receipt of goods, including a copy of the proof of purchase.

The seller reserves the right to test/check any goods returned as a result of fault or damage. If the returned goods condition is misrepresented by the buyer and the product is found not to be faulty or damaged after testing/checking by Earthen Body, we reserve the right to charge a $50 handling and administration fee.

When goods are replaced, your replaced goods become the property of the buyer and the faulty or damaged goods become the property of Earthen Body.

Fraudulent Purchases: Earthen Body will not be responsible for losses or damages suffered by a buyer whose credit card is used fraudulently to purchase goods from Earthen Body.

Personal Information

Your personal information supplied to Earthen Body is used to process your order. The buyer agrees that the seller may use, store and process this data for the purposes of fulfilling your order. Your details will remain the property of Earthen Body and will not be sold to any third parties. Your privacy is important to us, so we take every measure possible to ensure the safety of all your personal and professional information.

You also agree that from time to time Earthen Body may use that data to provide you with information pertaining to Earthen Body products and offers. If you do not wish to receive information sent to you, you may unsubscribe at anytime by contacting us by phone or email and advising such.

Trademarks & Images

The buyer and visitors to the Earthen Body website must not use any of the trademarks displayed on the site:

  • In or as the whole or part of the users’ own trademarks or trademarks visible on the site;
  • In connection with activities, products or services which are not ours;
  • In a manner which may be confusing, misleading or deceptive;
  • In a manner that disparages the trademark owner, Earthen Body or our information, products or services (including this site).

Acknowledgement

The buyer acknowledges that they have read in full the complete statement of these terms and conditions, understand it and agree to be bound by these conditions of sale before purchasing goods either via our telephone sales or by using the www.shopnatural.earthenbody.com.au website.

CORPORATE CHRISTMAS PROGRAM

The Corporate Christmas Program is designed for Businesses as a way to provide their staff, corporate suppliers and corporate customers with a unique and novel gift idea at Christmas time.

Here are the Terms & Conditions for this program:

  1. Vouchers can be purchased between the dates of the 1st of October through to the 20th December each year.
  2. To be eligible for corporate discounts, businesses must have an ABN.
  3. Corporate Discount is valued at 15% off the full valued menu item's price.
  4. Orders must be placed using the official Corporate Christmas Packages Order Form either using the Excel auto-calculating version, or the PDF version. Order Form must be returned via email to Earthen Body for processing.
  5. Vouchers can be ordered as one of or a combination of two Styles - A (Dollar Value Vouchers) and B (Massage & Healing Vouchers). Please refer to the current Corporate Christmas Packages Order Form for voucher and package details.
  6. We reserve the right to modify the two styles of vouchers offered each year at our discretion.
  7. Personalisation of the vouchers is provided free of charge if requested. If requested, a spreadsheet will be emailed for the names and details of the recipient/s to be completed. Return this spreadsheet promptly for your vouchers to be personalised.
  8. A Tax Invoice will be supplied and must be paid in full prior to delivery of the gift vouchers.
  9. Free delivery of the vouchers is provided to your business or a nominated agreed location. Alternatively the vouchers can be collected from the Earthen Body Clinic upon confirmation of readiness.
  10. All vouchers have a 3 year expiry from the date appearing on the gift voucher and as recorded at the Earthen Body Clinic Gift Voucher Registry.
  11. Awesome Boss Bonus:
    1. Purchase 6 vouchers and receive a $50 voucher for yourself or to gift to a loved one; OR
    2. Purchase 10 vouchers and receive a $100 voucher for yourself or to gift to a loved one.
    3. For the purchase of 11 or more vouchers, please contact us directly for a tailored bonus!
